FMLA regulations which went into effect this year provide that an eligible employee may take up top
26 workweeks of leave during a 12-month period to care for a family member who is a covered service
member with an injury or illness incurred in the line of duty. The employee's family member
must be undergoing medical treatment, recuperation or therapy or be in an outpatient status or be on
a temporary disability retirement list because of an injury or illness incurred in the line of
active duty. The injury or illness must render the member medically unfit to perform the
duties of the member's office, grade or rank.
