The U.S. Circuit Court of Appeals for the Seventh Circuit recently held that the 90-day limitations
period within which to file a lawsuit following receipt of a right-to-sue letter from the EEOC would
begin to run after the plaintiff received a second right-to-sue letter from the EEOC.
Plaintiff's former employer was unable to show that plaintiff received the first letter from the
EEOC, but intentionally or carelessly refused to open it. The first letter was returned
unclaimed.
