More details to this question:
I was injured on the job and transferred to another position. My salary was decreased by 4,500.00 annually ,I've been on the job for 17 years . Is this legal to decrease someone's salary due to a transfer to another position within the same employer? My doctor put me out of work for a month , my employer wouldn't honor my note, instead sent me a letter stating I had to return to work. I didn't return, in turn was terminated.

The key to success is the language in your doctor's report. Where there any restrictions on the time of return ? On your work ? We have doctors writing reports that say one cannot return to full job responsibility. The employer has no obligation to hold open a position which the employee cannot do. the best example is a fireman. He/she must carry 165 pounds up and down the ladder. Ed Dimon 732-797-1600
